Terms and Conditions of Entry

These terms and conditions apply to the Farm Africa Virtual Carol Concert prize draw.

The Farm Africa Virtual Carol Concert prize draw (the “prize draw”) is run in accordance with guidance from the Fundraising Regulator and the Gambling Commission under the Gambling Act 2005 and is licensed by the City of London council.

Farm Africa is an international organisation working to build a prosperous rural Africa. We work in DR Congo, Ethiopia, Kenya, Tanzania and Uganda growing agriculture, protecting the environment and developing businesses in rural areas. We help farmers to increase their harvests, build their incomes and sustain natural resources.

Description of prize draw

Entry into this prize draw is your chance to win a number of prizes kindly donated to Farm Africa include:

Further prizes may be added and announced up to one week before the draw closing date.

Please note that no physical tickets will be issued upon entering the prize draw. Names of entrants and their multiples (if applicable) will be fairly placed into the prize draw and names will be picked at random.

Who can enter

Prize Draw open to UK, Channel Islands and Isle of Man residents aged 18 years or over only, excluding employees of the Promoter (Farm Africa).

Entrants shall not be entitled to receive any prize unless they can substantiate that they comply with conditions above.

Opening/closing date & time

Prize Draw opens and closes for both online via the Farm Africa website and post entries at the dates and times shown on the website.

Entries open at 10am Thursday 28 October 2021.

Entries close at 12pm Tuesday 14 December 2021.

How to enter

Entry into the prize draw is completely optional. You can indicate your participation on the Farm Africa Virtual Carol Concert online registration form, the Farm Africa Virtual Carol Concert donation form or by post in response to invitation, whether you wish to take part.

For every £10 donated to Farm Africa, you can be entered into our prize draw to be in with a chance of winning the prizes above. Your donation can also count as multiple entries eg. £20 = two entries, £30 = three entries etc.

There is no cap (“Cap”) on the number of entries across online and post.

For any donations linked to the prize draw, we are not able to claim Gift Aid. If you decide at point of registration not to take part in the prize draw and this is clearly indicated, then you are welcome to claim Gift Aid if you are eligible and wish to do so.  

Donations made in connection with the Farm Africa Virtual Carol Concert and made with or without entry into the prize draw are not refundable.

Donations, whether linked to an entry or not, can be paid online by credit or debit card or by sending a cheque or postal order in the post. To find out more about the many ways you can donate, please visit our Donation FAQs.

Winner selection, announcement and contact

The draw will take place on 15 December 2021.

Subject to eligibility and compliance with all applicable terms and conditions, the first entry drawn at random from all eligible entries for each prize will win that prize.

Winners will be announced in the comments section of YouTube during the stream on 15 December 2021. The winners’ names will also be displayed on the event webpage following the event. The event is also being recorded so winners name may also appear in the recording which may be made available to re-watch or catch up in future.

Winners’ names may be used in reasonable Farm Africa publicity without further reference, payment or other compensation.

After the event, Farm Africa will make a reasonable number of attempts to contact the winners directly by email or phone (if provided). If arrangements for the delivery of the prize have not been made within 30 days of the announcement, Farm Africa reserves the right not to forfeit your prize claim.

There will not be any alternative prizes, no interest is payable and prizes are not transferable.

General

Farm Africa’s general terms and conditions also apply https://www.farmafrica.org/about/terms-conditions. Entry into the draw will constitute acceptance of these terms and conditions.

Farm Africa reserves the right to decline to accept an entry, cancel an existing entry and/or award any prize to an alternative winner if Farm Africa has grounds to believe that an entrant has breached any of these terms and conditions, acted fraudulently or illegally, or on other reasonable grounds, and Farm Africa shall have no liability to entrants for any loss or damage suffered arising from its exercising such rights.

Farm Africa reserves the right to modify, suspend or cancel the Prize Draw (without disclosure of reason and at Farm Africa’s absolute discretion) in whole or in part without prior notice. Farm Africa also reserves the right to amend these terms and conditions without prior notice. Any significant changes shall be notified via the website or by contacting entrants directly using the contact details provided to us on registration (such method to be determined by Farm Africa in its absolute discretion).

Farm Africa’s decisions made pursuant to these terms and conditions shall, once made, be final and binding.

No liability is accepted for:

1.     any loss or damage, including the right to receive a prize, suffered by any entrant if they have not complied with these terms and conditions or any relevant participation instructions;

2.     the loss, theft or delayed receipt of any communication or entry, or which is damaged or illegible, from which the entrant or winner cannot be identified or which has insufficient postage (proof of posting is not proof of receipt);

3.     any late bank payments;

4.     Farm Africa’s failure or inability to contact an entrant and/or award any prize due to any errors omissions or inaccuracies in the contact details provided or an entrant’s failure to update these if they change;

5.     loss or damage incurred by any entrant in connection with their participation in the Prize Draw or their use of any prize including but not limited to direct, indirect and/or consequential loss) or personal injury suffered or sustained in connection with the prize or any part of it;

6.     any failure or delay beyond Farm Africa’s reasonable control.

Farm Africa is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Prize Draw for loss of revenue, contract, profits, anticipated savings or loss of data, any special or indirect or consequential losses or any loss of goodwill or reputation. Nothing in these terms and conditions shall limit Farm Africa’s liability for death or personal injury caused by its negligence, fraud or for any other matter for which liability may not be limited by law.

All warranties, conditions or guarantees relating to the Prize Draw made by or on behalf of Farm Africa whether express or implied by law, in the course of dealings or otherwise, are excluded to the maximum extent permitted by law.

Farm Africa’s liability to any entrant shall be limited to the amount of any prize which have become due to that entrant.

Responsible gambling

Self exclusion: On request we will put a block on supporters’ records to exclude themselves from any future raffle or prize draw mailings. This block will remain unless we are asked by the individual to remove it. Privacy notice

Farm Africa will use entrants’ information, for the purposes of administering the Prize Draw. That information may also be shared with Farm Africa’s prize donors to the extent necessary for administering delivering prizes to winners.

All entrants will be added to our Farm Africa mailing list for the purposes of keeping you updated on details related to the Farm Africa Virtual Carol Concert via an e-newsletter. Users have the option to UNSUBSCRIBE from the mailing list at any point. At the point of registration, users also have the option to opt in to receive further general communications from Farm Africa which will include updates on our work, and promoting our other events and activities.

The prize draw and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
